1. Terms and Definitions

1.1. Definitions of the terms used in these Rules are given in art. 2 of the Agreement mentioned in the Preamble of these Rules.

2. General Conditions

2.1. Any individual who has reached the age of 18 and is not limited in legal capacity by a court decision (or, depending on the jurisdiction, another competent authority) can become a User of the Site / Services. In some jurisdictions, the minimum age requirements may be different. User is solely responsible for compliance with the laws of the jurisdiction in which he is located. Any responsibility of Bitpapa.com is completely excluded.

2.2. These Rules have been developed by Bitpapa.com and define the terms and conditions of use of the Site / Services, as well as the rights and responsibilities of Users and Bitpapa.com when using the Site / Services. The rules also apply to any relationships related to the rights and interests of third parties who are not Users of the Site / Services but whose rights or interests may be affected by the activities of Users of the Site / Services.

2.3. Users are required to thoroughly familiarize themselves with these Rules before using the Website / Services. By using the Website / Services, the User hereby fully and unconditionally agrees to be bound by these Rules.

2.4. These Rules may be updated or changed at any time by Bitpapa.com at its discretion. The current version of the Rules can be found on the Website in the relevant section of the user interface. Users are not required to be notified separately about any updates or changes to the Rules. The updated or amended Rules will take effect from the moment they are published on the Website in the relevant user interface section. By continuing to use the Website / Services after any changes, updates, or additions to the Rules, any User is agreeing to and accepting those changes.

2.5. The rights to the Website and its Services, as well as the use of the network address (domain name), belong to Bitpapa.com. However, Bitpapa.com provides access to the site and Services to all interested parties in accordance with these Rules, the User Agreement, and applicable regulations. Bitpapa.com grants the User with a limited, non-exclusive, non-subsidiary, non-transferable license to use the features of the Website and Services owned by Bitpapa.com, free of charge, valid worldwide, subject to the provisions of article 4 of these Rules.

2.6. Regarding the functioning and development of the Website / Services Bitpapa.com is guided by applicable regulations, these Rules and other special documents that have been developed or can be developed and adopted by Bitpapa.com to regulate the provision of Users with access to certain functions of the Site / Services.

2.7. No provisions of these Rules grant the User the right to use the results of intellectual activity, brand names, trademarks, domain names and other distinctive marks belonging to Bitpapa.com. The right to use the results of intellectual activity, brand names, trademarks, domain names and other distinctive property can only be provided by written agreement with Bitpapa.com.

2.8. Bitpapa.com is not responsible for the actions of third parties, including internet service providers, regarding the protection of communication channels used to transmit information to and from the Site / Service. Bitpapa.com also does not guarantee the continued availability and uninterrupted operation of the Site / Services.

3. Use of the Website / Services and Identification

3.1. Identification (KYC procedure) opens access to the full set of functions of the Services. Bitpapa.com reserves the right to independently determine and at any time, at its sole discretion, change both the set of functions of the Services available without identification (KYC procedure) and the process / rules of the KYC procedure.

3.2. Identification (KYC procedure) is free, voluntary and is performed by filling out a special form posted on the interface of the relevant Service (with additional photos and/or videos provided upon request).

3.3. During the identification process (KYC procedures), the User must provide Bitpapa.com with a special form. The form may request additional information from the User and may be changed at Bitpapa.com's discretion at any time.

3.4. Identification on behalf of a third party is prohibited. Users are obliged to fill in the relevant information in the account solely on their own, using only their own personal data.

4. Prohibited User Categories

4.1. The following categories of persons should not use the Website / Services:

• 4.1.1. persons under the age of 18. In some jurisdictions, the minimum age requirements may be different. The User is solely responsible for compliance with the laws of the jurisdiction in which he is located. Any responsibility of Bitpapa.com is completely excluded;
• 4.1.2. persons who are limited in their legal capacity by a court decision (or by another competent authority depending on the jurisdiction);
• 4.1.3. persons whose use of the Site / Services violates laws, regulations or other norms related to combating money laundering or terrorist financing, as well as the provisions of the AML / CFT / KYC Policy by Bitpapa.com;
• 4.1.4. persons whose access to the Website / Services had been limited by Bitpapa on the grounds that they provided false, incomplete, or unreliable data during the identification process (KYC procedure) or during interaction with Bitpapa.com as part of their dealings;
• 4.1.5. persons whose access to the Site / Services has been restricted by Bitpapa.com based on the use of the Site / Services for the purpose of carrying out illegal activities, including, but not limited to, hacker attacks, virus infections, malware distribution or other actions that may damage the Site / Services or may cause any damage or loss to other Users, Bitpapa.com or to third parties.

4.2. In case of violation of the conditions stipulated in clause 4.1 (including the sub-clauses), Bitpapa.com reserves the right to deny access to the account, suspend or block access to the Site/ Services without prior notice and without compensation for possible damages. Bitpapa.com is also entitled to notify the relevant law enforcement agencies if necessary.

5. Personal Data and Account Usage

5.1. The processing of the User's personal data is carried out in accordance with the Privacy Policy posted on the Website and/or in the relevant section of the interface of the relevant Service, as well as with applicable regulations.

5.2. Personal data (including any contact information) provided by the User during identification (KYC procedure) may be used by Bitpapa.com to make direct contacts in order to inform Users of the Site / Services about special offers, promotions, events, as well as about partner offers. By providing Bitpapa.com with the data mentioned above, the User unconditionally accepts this clause. The User can revoke this consent by sending a notification to the following email address: [email protected].

5.3. Bitpapa.com has the right to use data collected through the Website and Services to improve and refine its content, as well as to exchange information with Users, for marketing, research, and other legitimate purposes. Bitpapa.com also has the right to fully utilize all information received through the Website and Services in a non-personalized form.

5.4. Users do not have the right to transfer their data for access to the Services to third parties and are fully responsible for safety, independently selecting the method of data storage.

5.5. Unless the User proves otherwise, any actions performed using the account are considered to have been performed by the corresponding User. In case of unauthorized access to the User's account, the latter is obliged to immediately inform Bitpapa.com about it.

6. User Responsibilities and Prohibited Actions

6.1. The User must:

• 6.1.1. comply with the provisions of these Rules, of the User Agreement and other special documents by Bitpapa.com, applicable laws and regulations;
• 6.1.2. provide reliable, complete and up-to-date data during identification (KYC procedure), and monitor the data updating;
• 6.1.3. inform Bitpapa.com about unauthorized access to the account;
• 6.1.4. do not grant account access to third parties;
• 6.1.5. if there are doubts about the legality of certain actions Bitpapa.com recommends that any User refrain from doing so.

6.2. The User is prohibited from:

• 6.2.1. being identified (undergo the KYC procedure) on behalf of or instead of another person, or be identified (undergo the KYC procedure) by a group (association) of persons or a legal entity as a User disguised as one individual;
• 6.2.2. using another User's data;
• 6.2.3. distorting information about himself and his age;
• 6.2.4. using the software and performing actions aimed at disrupting of the normal functioning of the Services;
• 6.2.5. using automated scripts (programs, bots, crawlers) for collecting information on the Site (in the Services) and/or interacting with the Site (Service) and its functionality without special written permission from Bitpapa.com;
• 6.2.6. trying to gain access to another User's data in any way, including (but not limited to) by deception, abuse of trust, hacking;
• 6.2.7. carrying out illegal collection and processing of personal data of other persons;
• 6.2.8. using the Website / Services in a way other than through the interface(s) provided by Bitpapa.com;
• 6.2.9. granting access to the account to another person(s).

7. Third-Party Content and Links to Third-Party Resources

7.1. The Website / Services contain (or may contain) links to other websites and / or applications / bots / etc. owned and / or operated / administered by third parties. Some Services may be wholly or partly owned by third parties and / or wholly or partly operated by third parties.

7.2. The third parties specified in clause 7.1 and their websites and / or applications / bots / etc. (Services) are not subject of inspection (check-up) for Bitpapa.com. Bitpapa.com is not responsible for any information posted on websites / applications / bots (Services) of third parties as well as for any actions performed by them.

7.3. Links to other sites and / or applications / bots / etc. owned by third parties posted on the Site (or in the interface of any Service) do not imply support or approval of these sites and / or applications / bots / etc. by Bitpapa.com. A link to any website, application, bot, product, service, or any information of a commercial or non-commercial nature posted on the Website (or in the interface of any Service) does not constitute an endorsement or recommendation from Bitpapa.com.

7.4. The actions of a User who has clicked on links on the Website (or in the interface of any Service) to other websites and / or applications / bots / etc. owned and operated / administered by third parties are to be regulated by the mentioned third parties. Bitpapa.com does not bear any responsibility for the content of such sites / applications / bots / etc., as well as for the actions of their owners / administrators.

8. Functioning of the Services and Responsibility for Users

8.1. Users are solely responsible for their own actions. Violation of these Rules, of the User Agreement, and other special documents by Bitpapa.com as well as any violation of the applicable laws and regulations entail the responsibility of the User, any liability of Bitpapa.com is completely excluded.

8.2. Bitpapa.com provides a technical opportunity to use the Site / Services, but Bitpapa.com does not participate in the formation of the content of User accounts, does not control and is not responsible for the actions or omissions of any person in relation to the use of the Site / Services or the formation and use of the content of accounts.

8.3. Bitpapa.com reserves the right to change the design, content, functionality, and other aspects of the Site and Services at any time, without prior notice. This includes modifying or supplementing scripts, software, and other objects used on the Site or in the interface of the Services, as well as any server applications.

8.4. Bitpapa.com ensures the smooth operation of the Website and Services and strives to promptly restore their functionality in case of technical problems or interruptions, with the exception for Services that are owned or controlled by third parties. 9. Disclaimer of Liability

9.1. THE WEBSITE / SERVICES AND THEIR FUNCTIONALITY (INCLUDING ALL SCRIPTS, APPLICATIONS, CONTENT AND DESIGN OF THE WEBSITE / SERVICES) ARE DELIVERED "AS IS". Bitpapa.com DISCLAIMS ANY GUARANTEES THAT THE SITE / SERVICES OR THEIR FUNCTIONALITY MAY OR MAY NOT BE SUITABLE FOR SPECIFIC PURPOSES OF USE. Bitpapa.com DOES NOT GUARANTEE OR PROMISE ANY SPECIFIC RESULTS FROM THE USE OF THE SITE / SERVICES AND / OR THEIR FUNCTIONALITY.

9.2. BY USING THE SITE / SERVICES, THE USER AGREES THAT HE DOES IT AT HIS OWN RISK AND IS PERSONALLY RESPONSIBLE FOR THE POSSIBLE CONSEQUENCES OF USE, INCLUDING ANY DAMAGE THAT THIS MAY CAUSE TO THE COMPUTER OR ANY PROPERTY OF THE USER OR THIRD PARTIES, FOR DATA LOSS OR ANY OTHER NEGATIVE CONSEQUENCES.

9.3. UNDER NO CIRCUMSTANCES Bitpapa.com COULD BE RESPONSIBLE TO THE USER OR TO ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT, ACCIDENTAL, UNINTENTIONAL LOSS / DAMAGE (INCLUDING LOST PROFITS OR LOST DATA OR PROPERTY, OR OTHER DAMAGE, WITHOUT LIMITATION) CAUSED BY USING THE SITE / SERVICES, THE CONTENT OF THE SITE / SERVICES, OR BY CLICKING ON ANY LINK(S) POSTED ON THE WEBSITE / IN THE INTERFACE OF ANY SERVICE.

10. Resolution of Disputes

10.1. Any dispute between the Parties is a subject to settlement in accordance with the provisions of the User Agreement.
